Start with Excess Funds

Following an HOA foreclosure, the court may hold excess funds from the property sale. These funds can be critical in redeeming your property or addressing outstanding debts. An experienced attorney can help you claim these funds promptly and efficiently. You can generally use these funds toward the expense of buying your home back.

How a Lawyer Can Help

Here are six ways a lawyer like Hector Chavana Jr. can assist you with HOA foreclosure redemption:

  • Identify and claim excess funds held by the court.
  • Analyze the foreclosure process for any legal errors.
  • Negotiate with the HOA for a resolution.
  • Ensure compliance with Chapter 209 of the Texas Property Code, which governs HOA foreclosures. Learn more here.
  • Provide guidance on redemption timelines and documentation requirements.
  • Represent you in court if disputes arise during the redemption process.

Understanding HOA Redemption

How can I redeem my property after an HOA auction? Texas law provides homeowners the right to redeem their property after an Homeowner’s Association foreclosure under certain conditions. This process can be complex, involving strict deadlines and requirements. Having a knowledgeable attorney on your side can make all the difference. Generally, a homeowner can redeem his property after a foreclosure auction by paying the auction buyer for the funds it has expended to purchase the home, including, but not limited to, the purchase price, the deed fee, and any eviction fees. A homeowner has up to 180 days after the HOA sent a post-foreclosure notice of the foreclosure. The timeframe can be extended by a duly drafted request for a balance. Often, if we do not hear back from the seller, we will help calculate the balance and advise the client to send the funds anyway, in order to file an affidavit of redemption, and to try to stop the home from being sold by the foreclosure buyer to a third party.

Tax Redemptions

Even though Chavana Law, PLLC has helped redeem properties after HOA auction, Chavana Law, PLLC is not currently accepting clients who are looking to redeem a property after a tax auction. However there are many online resources that can give you information on the tax foreclosure redemption process.
